Thank you for your application for a temporary entry class visa – a work visa under Malaysia Working Holiday Scheme, which we received on 10 February 2017.

 Our assessment of your character

We have completed an initial assessment of your application and note that you are subject to New Zealand immigration instruction A5.45. This means that you are normally ineligible for a temporary entry class visa unless granted a character waiver.

  • You appear to previously have provided false and misleading information in course of applying for a visa.

As per instruction A5.45(b)(copy attached below), applicants who will not normally be granted a temporary entry class visa, unless granted a character waiver include any person who in the course of applying for a New Zealand visa, has made any statement or provided any information, evidence or submission that was false, misleading or forged, or withheld material information.

On 19 January 2017 you lodged a work visa application under the Germany Working Holiday Scheme while you are neither a citizen of Germany nor hold a passport from this country. Your previous application has been declined as you do not meet general conditions of working scheme requirements WI2.1.1(b)(i).

Based on the information available, it appears that you have provided false and misleading information on your previous application by submitting an application under the Germany Working Holiday Scheme, thereby claiming that you are a citizen of Germany despite not being so. You therefore do not meet the requirements of good character under immigration instruction A5.45(b) and are normally not eligible to be granted any further temporary class visa unless granted a character waiver.

We have not made a final decision on your application at this stage. We invite you to make comments or to provide further information to help us decide whether your circumstances justify waiving the temporary entry character requirements.

Further information

Any comments or further information must be provided by 22 February 2017.

The relevant provisions of New Zealand immigration instructions A5.45 are attached.  Please read these as they set out the relevant character requirements, including what matters will be taken into account when a character waiver is considered.

We recommend that you email your comments and/or additional information to me at xxx@mbie.govt.nz

Please note that any documents not in English must be translated into English by a recognised, independent translation service.

What happens if you do not send any comments or additional information?

If you do not send any comments or additional information to us by the date above we will decide your application based on the information you have already given us.

What happens if your circumstances change?

You must tell us about any changes to your circumstances that may affect your visa application including changes to the following:

the personal or family circumstances of any person included in the application

your address or contact details (including postal address, email address, and telephone number)

      your business or employment and

your course of study if you are applying for a student visa.

If you do not tell us about any change to your circumstances, we may your visa application or you may become liable for deportation. While you are in New Zealand, you must hold a valid visa at all times.

Contact us

You will need to tell us your application and client numbers (you will find these at the top of this letter). Please have them with you and be ready to quote them if you contact us.

  1. has been convicted at any time of an offence against the immigration, citizenship or passport laws of any country; or

  2. in the course of applying for a New Zealand visa, has made any statement or provided any information, evidence or submission that was false, misleading or forged, or withheld material information; or

  3. at the time of application:

  4. has been charged with an offence, which on conviction, would make

section 15 of the Immigration Act 2009 apply to that applicant; or

  1. is under investigation for such an offence; or

iii.         is wanted for questioning about such an offence; or

  1. has been convicted at any time of:

  1. in support of any application by another person for a New Zealand visa (or a permit under the Immigration Act 1987), has made any statement or provided any information, evidence or submission that was false, misleading or forged.

Note:
- When considering whether or not an applicant has committed an act that comes under A5.45 (b) or (e) above, immigration officers should establish whether, on the balance of probabilities, it is more likely than not that the applicant committed such an act.
- A5.45 (d) does not apply to individuals undergoing an appeal process against their liability for deportation who have applied for a temporary entry class visa of the same class and type they currently hold.
- For the avoidance of doubt, any offence in New Zealand that has the potential to result in a term of imprisonment of three months falls within the scope of A5.45(d)(ii). This includes, but is not limited to, potential sentences "not exceeding three months" or "up to and including three months".

Dear Mr XXX,

Good Day to you.

Please find the below info for your reference.

Application number: 12345678

Client number: 87654321

Firstly of all, I would like to express my appreciation for the chances given to me to explain regarding the Visa issue.

I would like to apology for the mistake happened that wrongly applied Working Holiday Visa under the country of Germany. On 19th Jan 2017, during midnight (Malaysia Time) I have logged into the immigration website just want to familiar with the website page so once the application open at least I know where to click to get the application form. As I noticed that the immigration website has been upgraded and is different from the previous one.

After login, choose the "Working Holiday Visa" tab, it allowed me to choose the country that I eligible to apply. I remember I have chosen Malaysia as my country then it allowed me to apply and the application form appears right on the screen. I was panic and I thought that the application already open, as the website is quite lag at the same time. then I quickly fill in the all detail and submitted. Most of the basic detail is actually filling by the google auto fill system, that why I spend a really short time and submitted successfully.

After awhile, I received a confirmation email from immigration said that I have successfully applied Working Holidays Visa under Germany and I was shocked. Then I quickly make a call to NZ Immigration help line to seek help. The officer advises me to send an email to working holidays email to withdraw the application. I have then sent an email to the email that provided and get a reply said already forwarded to the specific officer.

I so regretted that accidentally applied under the wrong country. As I have already planned to go NZ Working Holiday for this year and I know the quota for 1150 is quite competitive. I hope Mr. XXX can understand my unintended false and granted me a chance to work and travel around the beautiful country. The chances given are much appreciated by me. I hope Sir can see my sincerity on getting the Visa. I hope Sir can tolerate my mistake and I promise that there is no next time and will be more careful while choosing the country.

Attached below is my old passport for your perusal. They are the record that I travel around the world and I hope this can help to show that a young people's passion for traveling around the world.

Last but not least, I hope I can granted a Character Waiver as I am a good citizen in Malaysia and hopefully able to get forgiveness from your end.

Thank you

Best Regards,

XXX XXX XXXX
